When a State actor — a government department, a public authority, a regulatory body — makes a decision that affects an individual or business, that decision must be made lawfully. When it is not, the courts have the power to review it.
We act for individuals and businesses in matters where a public authority’s decision or conduct has caused harm or is being challenged on legal grounds.
Public law matters move quickly at certain stages and slowly at others. Time limits for filing judicial review applications are short — typically three months — and the consequences of missing them are severe. Our first task is identifying whether a matter is suitable for public law proceedings and whether the limitation position allows them.

Judicial review is the process by which the High Court reviews the lawfulness of decisions made by public authorities. The court examines the legality, rationality and procedural fairness of the decision — not whether the court would have made the same decision.
Generally, three months from the date of the decision being challenged. Time runs from the date of the decision, not from the date the applicant becomes aware of it, although this can be the same date in many cases.
The court can quash a decision, prohibit further action, compel a public authority to perform a duty, or grant declaratory relief. Damages are sometimes available where the breach also gives rise to a private law cause of action.
